The ISGH Health Access Card Program (“Program”) is a charitable community assistance initiative operated by the Islamic Society of Greater Houston, Inc. (“ISGH”), a Texas nonprofit religious and charitable organization recognized under Section 501(c)(3) of the Internal Revenue Code.

PLEASE READ THESE TERMS CAREFULLY BEFORE USING THIS WEBSITE OR PARTICIPATING IN THE PROGRAM.

By accessing this website, applying for a card, accepting a card, or using any Program related services, you acknowledge and agree to the following:

ISGH IS NOT A HEALTHCARE PROVIDER

ISGH is not a hospital, physician practice, medical clinic, pharmacy, healthcare provider, health insurance company, health maintenance organization (HMO), managed care organization or a medical referral service.  ISGH does not practice medicine, diagnose medical conditions, prescribe medications, provide treatment, supervise medical care, or exercise control over the professional judgment of any healthcare provider.  Nothing on this website constitutes medical advice or healthcare treatment.  Always seek advice from a qualified healthcare professional regarding medical conditions or treatment decisions.

NO MEDICAL ADVICE

The information provided on this website is for general informational and charitable assistance purposes only.

PARTICIPATING PROVIDERS ARE INDEPENDENT

Healthcare services are provided solely by independent third-party providers (“Participating Providers”).  Participating Providers are not employees, agents, representatives, partners, or joint venturers of ISGH.  ISGH does not supervise providers, control medical decisions, guarantee provider availability, evaluate quality of care, guarantee pricing or discounts or assume responsibility for provider conduct or treatment outcomes.  Any medical services, reduced cost care, or charitable accommodations are determined solely by the Participating Provider.

THE PROGRAM IS NOT INSURANCE

The ISGH Health Access Card is not insurance. The Program is NOT a health benefit plan, an insurance policy, an HMO or managed care plan, does not guarantee payment of medical expenses, does not reimburse healthcare costs and does not create any obligation for ISGH to pay medical bills.  Cardholders remain solely responsible for all healthcare costs, provider charges, prescription expenses, deductibles, co-payments, laboratory fees, imaging fees, hospital charges, and related expenses.  Participation in the Program is not a substitute for obtaining independent health insurance coverage.

NO GUARANTEE OF SERVICES OR SAVINGS

ISGH does not guarantee eligibility for healthcare services, acceptance by any provider, continued provider participation, appointment availability, free medical treatment, discounted pricing, prescription availability or any specific medical outcome.  Provider participation may change at any time without notice.

NO LIABILITY FOR MEDICAL SERVICES

To the fullest extent permitted by Texas law, ISGH disclaims all liability arising from medical treatment, delayed treatment, provider negligence, malpractice, billing disputes, denied services,  collections activity, prescription issues, healthcare outcomes or reliance upon information contained on this website.  All healthcare decisions and medical treatment are solely between the patient and the healthcare provider.

RELEASE AND HOLD HARMLESS

By participating in the Program, users agree to release, indemnify, and hold harmless ISGH, its affiliated mosques, directors, officers, employees, volunteers, donors, agents, and representatives from any and all claims, liabilities, damages, losses, costs, or expenses arising from use of the Program, use of the website, interactions with Participating Providers, medical treatment or failure to treat, billing disputes or reliance upon Program information.

PROGRAM ELIGIBILITY AND TERMINATION

ISGH reserves the right, in its sole discretion, to approve or deny applications, request financial documentation, suspend or revoke participation, modify eligibility requirements, discontinue providers or terminate or modify the Program at any time without notice.  Participation in the Program does not create any contractual right or entitlement to services.

PRIVACY AND INFORMATION SHARING

Applicants may be asked to provide personal and financial information for eligibility verification and Program administration purposes.  By using the Program, applicants authorize ISGH to share limited information reasonably necessary to administer the Program and communicate with Participating Providers.  ISGH will make reasonable efforts to safeguard submitted information; however, no electronic transmission or storage system can be guaranteed completely secure.

NO ENDORSEMENT

References to Participating Providers, clinics, pharmacies, hospitals, or other healthcare entities do not constitute endorsements, guarantees, certifications, or recommendations by ISGH.  Users are solely responsible for independently evaluating healthcare providers and treatment options.

CHARITABLE PURPOSE

The Program is operated exclusively for charitable and community assistance purposes in furtherance of ISGH’s religious and nonprofit mission.  No portion of the Program is intended to constitute the business of insurance, healthcare delivery, or commercial medical services.

GOVERNING LAW

These terms shall be governed by and interpreted under the laws of the State of Texas.  Any disputes relating to the Program or website shall be subject to the exclusive jurisdiction of the courts located in Harris County, Texas.
